The Journeyman Terms & Conditions
These Terms and Conditions (“Terms”) govern your access to and use of The Journeyman platform (“Platform”). By using the Platform, you agree to be bound by these Terms. If you do not agree, you may not access or use our services.
1. User Accounts
Users must create an account with accurate and up-to-date information. Users are responsible for maintaining the confidentiality of their account credentials and must notify The Journeyman immediately of any unauthorized use.
2. Permitted Use
The Platform may only be used for lawful purposes related to wildland fire operations, emergency response, training, and professional networking. Any misuse, reverse engineering, or unauthorized access is prohibited.
3. Intellectual Property
All software, databases, designs, and content within The Journeyman Platform are owned by The Journeyman and protected under applicable copyright and intellectual property laws. Users are granted a limited, revocable license to use the Platform.
4. Incident Tracking and Management
The Journeyman provides tools for users and companies to record, manage, and analyze incidents for operational improvement. Companies may choose to enter information such as incident descriptions, personnel, equipment, or financial data. Entering financial or cost-related information is optional. This data is visible only to the company owner and authorized admins and is not accessible to The Journeyman staff or any other company.
The Platform’s incident tools are provided for informational and analytical purposes only. The Journeyman is not liable for errors, omissions, or inaccuracies in data entered by users or companies.
5. Data Ownership and Confidentiality
All data entered into the Platform by a company, including incident, roster, or financial data, remains the property of that company. The Journeyman acts solely as a service provider for data storage and management. We do not claim ownership of or distribute user or company content.
6. Subscriptions and Payments
Company subscriptions are managed through The Journeyman’s secure Stripe payment system. Payment obligations are non-refundable except as required by law. Subscription features and limits are described within the Platform and may vary by plan.
7. Communications and Notifications
Registered users and companies may send or receive notifications, SMS messages, and emails through the Platform. All communications must comply with Twilio’s Messaging Policy and relevant telecommunications laws.
8. Limitation of Liability
The Journeyman is provided “as is” and without warranties of any kind. We are not liable for indirect, incidental, or consequential damages arising from use of the Platform, including any loss of data or operational disruptions.
9. Indemnification
Users and companies agree to indemnify and hold harmless The Journeyman, its affiliates, and personnel from any claims arising from their use of the Platform, including data entered, communications sent, or operations managed through the app.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of South Dakota, USA, without regard to its conflict of law provisions.
